Interesting Studies Prove False Confessions Are Relatively Easy For Law Enforcement to Obtain

Follow the "view full press release" link below to a fascinating article published in the August 13, 2011 issue of The Economist discussing new studies which show that people, when placed under even slight amounts of pressure have a tendancy to admit to doing things they have not in fact done. 

These studies offer yet more proof that false confessions happen in our criminal justice system.  Our attorneys are well versed in techniques which can be used to challenge and undermine the techniques used to extract such "confessions" and in discrediting the "confession" itself.

Drug/DRE OUIs On the Rise in Maine

All of us at The Hallett Law Firm have noticed a huge uptick in the number of drug OUI's that are being cited in Maine over the past several years.  These are OUI charges which allege impairment as a result of drug use (either prescription drugs or prohibited drugs), rather than as a result of the consumption of alcohol.  So we weren't surprised, although we were alarmed, with the recent release of the study revealing that Maine was at the top of the list of State's whose resident's suffer from prescription drug abuse.  Unfortunately, otherwise legal use of a drug prescribed by a doctor can still expose you to arrest for operating under the influence.  We recognize that this arrest can be the low point of someone's life - but there is a long way from arrest to conviction in these cases, and much that one of our lawyers can do for you.  If you find yourself in the situation, please call us for a free consultation.

Firm Excels in Pursuing Claims Against Commercial Motor Vehicles

Thomas Hallett and David Weyrens have recently successfully prosecuted a wrongful death claim stemming from a tragic accident caused by a commercial truck.  While the surviving family will never fully recover from the loss of their loved one, they were able to realize a maximum recovery in a very prompt fashion.  Unfortunately, that is the best that can be done in these terrible circumstances.

Walsh avoids jail time in Brownfield neighbor feud

PARIS — A Brownfield man who was shot by his next-door neighbor in July won't receive jail time as part of a deal with the District Attorney's office.

James Walsh, 38, had six charges dismissed Monday after pleading guilty to domestic violence assault and criminal mischief. Walsh was also facing charges of domestic violence, terrorizing, theft by unauthorized use of property, burglary, theft by unauthorized taking and harassment by telephone.

Dramatic audiotape of police wrongdoing emerges in police shooting case

The Hallett Law Firm this week filed a Notice of Claim against the Cumberland County Sheriff's Department on behalf of of a man who was shot three times by sheriff's deputies while standing in his own home. Tom Hallett this week released the Sheriff's Department's own audiotape recording of the incident which reveals that the deputies did not identify themselves as law enforcement while banging on the door in the dark of the night and yelling, "open up the door." They then proceeded to shoot the man through the windows of his own home. As a result of the shooting the client lost his right arm just below the shoulder, and will likely require a hip replacement.
