Will I lose my license?

Do I need a lawyer?

I failed the field sobriety test, now what?

First, don't take the field sobriety tests. They are not mandatory in Maine and they are designed for you to fail them. I only had a couple drinks.

Anecdotally, the most common answer given when being pulled over is "I only had a couple of drinks." Cops take this to mean you are drunk. Don't say it! If you really only had a couple of drinks you are probably under the legal limit unless you are small statured, were drinking mixed drinks or a "dragon bowl," or are under a restricted license.

I think my rights were violated.

This happens more than you might imagine. We recently won a second offense OUI where the cop claimed our client crossed the center line. He also claimed that it was snowing and several inches of snow covered the road. After a lengthy hearing the judge agreed that the cop had no idea that our client crossed the center line because the center line was covered with snow. That case was dismissed and is just one example of many.
